What’s a Living Will….More Than a Moral Choice?

A living will is more than a healthcare directive.  It’s an asset manager and protector.  We often look upon a living will as some moral decision. That’s not the only benefit!  It’s a well considered and executed financial decision.  Spiraling healthcare cost for someone being connected to machines when death is imminent only drains the estate. There is lesser money for your family to go forward with. No one wants that! So consider this when completing a healthcare directive/Living Will, it’s both a moral and fiscally prudent thing to do. What’s In Your Parachute?

I always advise my clients that leaving no will is like jumping out of an airplane without a parachute. The end results are normally not anticipated.  What most people don’t know is that the state will declare a will for you when you fail to make a written one. It’s call an “intestate” will or statutory will. It simply mean, dying without a written will. The problem with this is it may not be what you want. Most times it is not. Human being and relationships are more complicated these days and quite frankly the probate laws have not caught up to… Read More →

July total bankruptcy filings decrease 8%. Does this mean that things are getting better for the consumer? Maybe, maybe not. IRS Problems Don’t Go Away by Themselves!

This is something that we all know but all are guilty of….procrastination. Sometimes the problems seems so annoying that evading or ignoring it seems the best remedy at the time. Now I realize after saying this is that the reason most… Read More →

Missouri’s New Gun Legislation Is Dangerous!

Jimerson, Herman Owner, Jimerson Law Firm, P.C. Missouri lawmakers have passed dangerous legislation regarding the possession of guns, whether concealed or not. Effective January 1, 2017, all citizens of Missouri may lawfully carry concealed weapons without obtaining the proper training or certification. In the past, Missouri required individuals to go through an investigative process with the Sheriff in the county of their residence to receive a concealed carry permit. This at least provided a basic background check to determine whether the applicant was legally and mentally fit to carry a concealed weapon. Under this new law, the permit process is… Read More →

Considering the Criminal Defendant Client as a Human

WHAT CRIMINAL DEFENSE ATTORNEYS SOMETIMES NEGLECT MAY BE COSTLY; AND THE COST OF OVERLOOKING MITIGATING CIRCUMSTANCES MAY BE “FREEDOM” When it comes to advocating for justice, I can’t think of many higher callings than the criminal defense attorney. The criminal defense attorney takes on cases that other attorneys may shudder and run simply because the allegations are too horrendous. It takes a powerful sense of pride and belief in the institutions of this country to represent someone in a criminal matter. Advocacy and belief in a client’s innocence should not be the only factor in preparing their case. The attorney… Read More →
